In relation to the issuing of licences by the Population Office please can you supply the following?

A

The number of registered approvals

The number of registered licences that have been removed since 1 January 2017

The number of licenced approvals

B

The number of these registered and licensed approvals that are currently being used.

C

It is noted that the States of Jersey do not technically have to operate under the same rules as the private sector - please indicate in the above numbers the with and without States employees.

D

A reconciliation with the most recent manpower figures if possible split across the broad industries of retail, tourism, agriculture, technology, finance, professional services, construction, health, education, sports, other and Public / States of Jersey. Please indicate whether these include business that the States participate in directly or indirectly for example, JT, Andium, Ports of Jersey and so on.

This information is absolutely exempt under Article 23 of the Freedom of Information (Jersey) Law 2011 as the information is accessible by other means. See link below for published data for Quarter 1 (January to March 2017).

Each quarter and annually we publish data on staffing permissions that have been requested, granted, refused, removed and the number of Registered and Licensed permissions held. This data is available for previous years from the same site.

We are also applying an Article 36 exemption as the Information is intended for future publication. Quarter 2 data will be published shortly online in the same location as existing published data.

This information is absolutely exempt under Article 23 of the Freedom of Information (Jersey) Law 2011 as the information is accessible by other means.

As the Labour Market Report is published half yearly by the Jersey Statistics Unit the information from January 2017 to date is not currently held. The next publication is due on 3 November and will be published online in the same location.

It is not correct that the States of Jersey do not operate under the same rules as the private sector. This was correct under the former Regulations of Undertakings and Development (Jersey) Law 1973, when the States of Jersey was exempt from the Law. Following the introduction of the Control of Housing and Work (Jersey) Law 2012 the States of Jersey is not exempt from this legislation

23 Information accessible to applicant by other means

(1) Information is absolutely exempt information if it is reasonably available to the applicant, otherwise than under this Law, whether or not free of charge.

(2) A scheduled public authority that refuses an application for information on this ground must make reasonable efforts to inform the applicant where the applicant may obtain the information.

36 Information intended for future publication

(1) Information is qualified exempt information if, at the time when the request for the information is made, the information is being held by a public authority with a view to its being published within 12 weeks of the date of the request.

(2) A scheduled public authority that refuses an application for information on this ground must make reasonable efforts to inform the applicant –

(a) of the date when the information will be published;

(b) of the manner in which it will be published; and

(c) by whom it will be published.

(3) In this Article, “published” means published –

(a) by a public authority; or

(b) by any other person.
