Request

How much do the Doctors providing medical care for La Moye Prison get?

Please can I have minutes of meetings associated with the choice of medical provider for Prison Services.

Response

The States of Jersey Prison Service is unable to provide this information as to do so could jeopardise any future tendering process. Article 33 (Commercial Interests) of the Freedom of Information (Jersey) Law 2011 has been applied.

Please see also the response to a similar Freedom of Information request answered in 2017 for further information:

Prison medical services (FOI)

The States of Jersey Prison Service can confirm that the delivery of medical care to La Moye Prison is currently provided under a three year contract with an option to extend to five years.

The tender process is an open one and complies with the States of Jersey tender policy. When last tendered, the Invitation to Tender was posted on the Channel Island Tenders portal.

Channel Island Tenders

If a supplier is registered, tender opportunities in their area of interest will be emailed to them. Alternatively, potential suppliers can look for current opportunities at any time. Not being registered does not preclude a supplier from doing business with the States of Jersey.

Article applied

Article 33 Commercial interests

Information is qualified exempt information if –

(a) it constitutes a trade secret; or

(b) its disclosure would, or would be likely to, prejudice the commercial interests of a person (including the scheduled public authority holding the information).

Prejudice / public interest test

Article 33 (b) allows an authority to refuse a request for information where its disclosure would, or would be likely to, prejudice the commercial interests of a person (including the scheduled public authority holding the information). Whilst we accept that the public may have an interest in the value of the contracts between the States of Jersey and medical service providers, we believe the contract values are commercially sensitive as they are the outcome of negotiations between parties and that the release of this data could affect the negotiation of future contracts. Similarly release of the minutes of meetings associated with the choice of medical provider for La Moye Prison could jeopardise the commercial equality of future tender offers for this service.
