In the last ten years how many misconduct or gross misconduct charges have been reversed or reduced after an appeal hearing, specifically relating to states of Jersey employees? If possible could this be broken down into departments, eg Health & social services, Education, treasury & resources etc. Also, of those who have been subject of a disciplinary how many have resulted in dismissal as a result?

Response

Due to certain States of Jersey departments having low levels of disciplinary cases, Article 25 of the Freedom of Information (Jersey) Law 2011 has been applied. As a result of this, departments have been consolidated to prevent the possibility of identifying an individual.

54 employees subject to disciplinary action in the last 10 years have been dismissed.

Five recorded cases of misconduct charges or gross misconduct charges were reversed or reduced after an appeal.

Article 25 Personal information

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2005.

(2) Information is absolutely exempt information if –

(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2005; and

(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.
