This information is considered commercially sensitive and therefore exempt from release further to Article 33 (Commercial Interests) of the Freedom of Information (Jersey) Law 2011.

As at 12 June 2019 fifteen reports have been made.

No reports have resulted in disciplinary action to date; Ten cases of bullying & harassment have been resolved by informal resolution through the Government of Jersey trained mediators (ACAS). Three of the fifteen cases are currently under investigation review.

Two cases have been closed with no action due to lack of information provided. This was despite repeated attempts via Expolink for the complainant to provide more detailed information to enable further action.

(b) its disclosure would, or would be likely to, prejudice the commercial interests of a person (including the scheduled public authority holding the information).

Article 33 (b) allows an authority to refuse a request for information where its disclosure would, or would be likely to, prejudice the commercial interests of a person (including the scheduled public authority holding the information). It is considered that this information is commercially sensitive and may compromise future negotiations of cost which would not be in the public interest.
