My request relates to the 2018 Request for Proposals for the feasibility study commissioned by the Guernsey and Jersey Governments regarding the introduction of a Computer Emergency Response Facility (CERF) for the Islands.
Would you please provide the following information:
How many suppliers submitted tenders for the work?
Of the suppliers counted in (A), above:
How many were based in Jersey?
How many were based in Guernsey?
How many were based elsewhere?
Where was the winning supplier based (Jersey, Guernsey or elsewhere)?
What was the total cost of the winning tender?
How were the costs split between the Jersey and Guernsey governments?
The information requested is not held. Information is only held on the registered office of each supplier. Two had registered offices in Jersey and three had registered offices in the UK.
The successful supplier has its registered office in the UK.
Information is held by the Scheduled Public Authority (SPA) however it is exempt under Article 33(b) of the Freedom of Information (Jersey) Law 2011.
Costs were split equally between Guernsey and Jersey.
Article 33 Commercial interests
Information is qualified exempt information if –
(a) it constitutes a trade secret; or
(b) its disclosure would, or would be likely to, prejudice the commercial interests of a person (including the scheduled public authority holding the information).
Public Interest test
Article 33(b) allows an authority to refuse a request for information where its disclosure would, or would be likely to, prejudice the commercial interests of a person (including the SPA holding the information). In this instance the SPA believes that the winning tender is commercially sensitive and release could harm the commercial interests of the SPA in respect of ongoing tenders in related areas of its business.
