Please can you publish any drawings / reports relating to the phasing / delivery of the infrastructure including roads, car parks and roundabouts for the proposed Esplanade masterplan area which are held by any of TTS, Planning Department and SoJDC.

Response from the Department of the Environment

All submitted drawings / reports relating to the proposed Esplanade masterplan area, where a decision was made after May 2012, are available for viewing within the link below.

Department of the Environment

All submitted drawings / reports relating to the proposed Esplanade masterplan area, where a decision was reached prior to May 2012, are available for viewing at the Department of the Environment’s South Hill offices upon request. Office hours are 8.30am to 5pm, Monday to Friday (excluding bank holidays).

Customers should phone the department in advance on +44 (0) 1534 445508 to preorder files, quoting the reference number or full site address. When the files have arrived customers will be notified and invited to come up to the department to view drawings, reports and decision notices.

Response from Transport and Technical Services

Transport and Technical Services does not hold any further information to that which was submitted to the Department of the Environment’s planning section as part of the proposed Esplanade masterplan application.

Response from Treasury and Resources

Treasury and Resources Department are the 100% shareholder of States of Jersey Development Company (SoJDC) and have responded as below:

All Scheduled Public Authorities (SPA’s) are separate legal entities for the purposes of the Freedom of Information (Jersey) Law 2011. Therefore, if a request comes in via the States of Jersey central FOI unit it will be disseminated to the most relevant SPAs that are central States of Jersey entities. In respect of this request, as shareholder, Treasury and Resources are the most appropriate department to handle and respond to your request in relation to SoJDC.  As shareholder, Treasury and Resources will only hold a certain amount of information regarding its shareholding companies.

The information requested is not the type of information which Treasury and Resources hold nor is it held on behalf by SoJDC as there is no legitimate reason why, as a shareholder, Treasury and Resources would either request that information or need it.

Treasury and Resources therefore refer the requester to the following:

“Freedom of Information Law (Jersey) Law 2011

Article 10 Obligation of scheduled public authority to confirm or deny holding information.

(1) Subject to paragraph (2), if

(a) a person makes a request for information to a scheduled public authority; and

(b) the authority does not hold the information, it must inform the applicant accordingly.”

Treasury and Resources​ do not hold this information.

It is intended for SoJDC to become an SPA at some point in the future and when SoJDC is listed in the Schedule to the Law, the requirements of the Freedom of Information (Jersey) Law 2011 will be applicable.  However, a date as to when this will come into effect has not been confirmed.

There is however nothing preventing you from addressing an FOI request directly to SoJDC. It is ultimately a matter for SoJDC to assess whether it has any obligations in respect of the FOI Law.
