Does the former Odeon Cinema building retain its listed status under the relevant planning law?

If yes, what obligations are placed upon the owners of the said building to maintain it in good order for it to retain its listed status?

A

Yes, the former Odeon cinema building retains its grade 1 listed status under the current planning law.

B and C

Articles 66, 84 and 86 of the Planning and Building (Jersey) Law 2002 apply to all buildings. These Articles relate to the condition of land or buildings becoming dangerous or despoiling the amenities of the Island. Otherwise there are no formal maintenance obligations imposed on the owner of any building.

However, any development work and activities carried out at the site must be approved in accordance with Article 19 or Articles 54 and Article 55 to ensure it retains its listed status.

The responsibility for Listed Buildings lies with the Planning Section of Infrastructure, Housing and Environment under Powers delegated by the Minister. Planning do not generally carry out inspections on listed buildings unless a specific planning application or complaint has been received.
