The Government of Jersey budget proposition makes reference to the tender process for Our Hospital. Please confirm all responses that were received for the 2019 request to bid on the design and build contracts for the hospital?

Response

Section six of the Outline Business Case sets out the procurement strategy and process for the appointment of the Design and Delivery Partner.

The Our Hospital Outline Business Case was published on 22 July 2021 as R.124/2021. This is publicly available and therefore Article 23 of the Freedom of Information (Jersey) 2011 (Jersey) Law has been applied. Please see the following link:

The unsuccessful bidders are not named in the Outline Business Case due to the commercial nature of information supplied in confidence during the procurement process. Article 33(b) of the Freedom of Information 2011 (Jersey) Law (commercial interests) has been applied in this response.

Article 23 - Information accessible to applicant by other means

(1) Information is absolutely exempt information if it is reasonably available to the applicant, otherwise than under this Law, whether or not free of charge.

(2) A scheduled public authority that refuses an application for information on this ground must make reasonable efforts to inform the applicant where the applicant may obtain the information.

Article 33 (b) - Commercial Interests

Information is qualified exempt information if –

(b) its disclosure would, or would be likely to, prejudice the commercial interests of a person (including the scheduled public authority holding the information).
