Reports regarding fires at Retreat Farm (FOI)

Produced by the Freedom of Information office
Authored by Government of Jersey and published on 02 February 2022.
Prepared internally, no external costs.

Request

Can you please provide me with any reports / documentation in relation to the glasshouse fires at Retreat Farm, St Mary / St Lawrence, formerly known as Tamba Park on:-

  • 19 April 2017
  • 27 August 2017
  • 03 September 2019
  • 16 July 2021 (this included a haulage truck)

Response

There is an Order in place which requires payment of a fee to the Jersey Fire and Rescue Service (JFRS) for the reports requested.

Fire and Rescue Service (Charges) (Jersey) Order 2012 (jerseylaw.je)

To provide these reports through the Freedom of Information (Jersey) Law 2011 would result in financial loss to the Scheduled Public Authority holding the information, in that the fee required by the Order would be obviated. Therefore Article 33 (b) of the Freedom of Information (Jersey) Law 2011 applies.

It is accepted that there may be public interest in the information sought, however disclosure would prejudice the financial interests of the JFRS and the Government of Jersey and it is therefore considered that the limited public interest is outweighed by the likely financial loss. Further enquiries regarding how to access these reports should be made directly to the JFRS at s.admin@gov.je

Article applied

Article 33 (b) – Commercial interests

Information is qualified exempt information if –

(a) it constitutes a trade secret; or

(b) its disclosure would, or would be likely to, prejudice the commercial interests of a person (including the scheduled public authority holding the information).
