II understand that the Off the Rails Café of Pt Rte des Mielles, Jersey JE3 8FA has Jersey Property Holdings as it's Landlord.
I would therefore like to know what rent was originally agreed for these premises and when is the next time this lucrative spot is up for tender?

Response

The lease for this ground site is due for renewal on 17 July 2023. However, Jersey Property Holdings do not tender lease opportunities on the open market if the sitting tenant wishes to remain and fair and proper terms are agreed. 

Details of the original rental fees are commercially sensitive and will therefore not be released in accordance with Article 33 of the Freedom of Information (Jersey) Law 2011 at this time.

Information is qualified exempt information if –

(b)     its disclosure would, or would be likely to, prejudice the commercial interests of a person (including the scheduled public authority holding the information). 

Public Interest test 

Whilst it may be in the public interest to provide details of rental fees charged in relation to the 'Off the Rails' site, the release of this information could potentially disadvantage the tenant and damage the Government's ability to retain commercial advantage in any future rental negotiations regarding this site.  

Therefore, we consider that the likely prejudice to the tenant and to the Government, should this information be released, outweighs the argument in favour of release to the public.
