I should be grateful if you could provide me with a copy of the review undertaken by Health and Safety Inspectorate in 2021 into Medicinal Cannabis Industry. 

Response

The Health and Safety Inspectorate, which sits within Justice and Home Affairs, is responsible for the administration and enforcement of the Health and Safety at Work (Jersey) Law 1989 (HSW Law). Article 20 of the HSW Law places strict controls over the disclosure of information gained by Inspectors whilst exercising their powers afforded by the Law.

The review carried out of the medicinal cannabis industry in 2021 was conducted using powers under Article 12 of the HSW Law and disclosure of the information is therefore prohibited by Article 20 of the Law.

Article 29 of the Freedom of Information (Jersey) Law 2011 has been applied.

Article 29 - Other prohibitions or restrictions

Information is absolutely exempt information if the disclosure of the information by the scheduled public authority holding it –

(a) is prohibited by or under an enactment;

(b) is incompatible with a European Union or an international obligation that applies to Jersey; or

(c) would constitute or be punishable as a contempt of court.
