Response

This request refers to a named individual who is an independent planning inspector in Jersey.

The information requested by both questions is absolutely exempt by virtue of Article 23 of the Freedom of Information (Jersey) Law 2011 as it is accessible to the applicant by other means.

Article 23(2) requires that we make reasonable efforts to inform the applicant where they may obtain the information requested and this is described below.

All Ministerial Decisions are published on www.gov.je. Using the search box on that page it is possible to search for the name of any planning inspector and retrieve all decisions for which they provided a report to the Minister going back to the beginning of the current planning appeals system using independent planning inspectors in 2015.

Article 23 - Information accessible to applicant by other means

(1) Information is absolutely exempt information if it is reasonably available to the applicant, otherwise than under this Law, whether or not free of charge.

(2) A scheduled public authority that refuses an application for information on this ground must make reasonable efforts to inform the applicant where the applicant may obtain the information.
