Positions of Trust and the Sexual Offences (Jersey) Law 2018

Please would you advise the following to include complaints and or referrals made to the Jersey Designated Officer:

A

The number of complaints recorded in Jersey between 23 November 2018 to-date (listed by year) in which sexual activity with a 16 or 17-year-old has been reported that involved a person who was in a Position of Trust. Please include the nature of the role of the person in a Position of Trust, for example, sport, faith, education, and so on.

B

The number of complaints recorded in Jersey between 23 November 2018 to-date (listed by year) in which sexual activity with an adult has been reported that involved a person who was in a Position of Trust. Please include the nature of the role of the person in a Position of Trust, for example, sport, faith, education, and so on.

C

The number of complaints recorded in Jersey between 23 November 2018 to-date (listed by year) in which sexual activity with a child under 16 years of age has been reported that involved a person who was in a Position of Trust. Please include the nature of the role of the person in a Position of Trust, for example, sport, faith, education, and so on.

D

Of the number of complaints recorded above, please advise the outcome of each complaint if known.

Under 18’s

Please see the attached tables for data relating to complaints or referrals made to the Jersey Designated Officer for the reasons specified (including historic reporting) in respect of those under 16 years of age, and separately for those aged 16 or 17 years old, from 2018 to-date.

Adults

Please see the attached table for data relating to complaints or referrals made to the Jersey Designated Officer for the reasons specified in respect of adults, from 21 November 2019 to-date.

Please note that prior to 21 November 2019, adult safeguarding concerns were not categorised in a central database by the type of abuse alleged or safeguarding concern raised, though this detail would be held in individual care records. Examining individual records would exceed the timescales prescribed in the Freedom of Information (Costs) (Jersey) Regulations 2014. Therefore, Article 16 of the Freedom of Information (Jersey) Law 2011 has been applied in this respect.

Article 16 - A scheduled public authority may refuse to supply information if cost excessive

(1) A scheduled public authority that has been requested to supply information may refuse to supply the information if it estimates that the cost of doing so would exceed an amount determined in the manner prescribed by Regulations.
