St John's Road trial scheme correspondence (FOI)​

​Further to the recent Freedom Information in the link above, please advise on the following:

A

The earliest date the Minister (Deputy Binet) was briefed on the subject of the St John’s Road Trial scheme.

B

The earliest date the Parish of St Helier approached him with respect to the scheme. 

C

The earliest date officers in the Government of Jersey briefed him relating to the scheme. 

D

Please confirm the date that he gave his support for the scheme either vocally or in written form to either the Parish or civil service.

The Government of Jersey has not maintained a record regarding when the various parties were first notified and briefed on this matter, therefore, Article 10 of the Freedom of information (Jersey) law 2011 applies.

However, a Parish of St Helier Roads Committee meeting was held on 12 April 2023 regarding the St John’s Road Trial scheme.

The information requested is exempt under Article 23 of the Freedom of Information (Jersey) Law 2011 as the information is accessible on www.gov.je within the previous Freedom of Information responses linked below.

Article 10 - Obligation of scheduled public authority to confirm or deny holding information

(1) Subject to paragraph (2), if –

(a) a person makes a request for information to a scheduled public authority; and

(b)     the authority does not hold the information, it must inform the applicant accordingly

Article 23 - Information accessible to applicant by other means

(1) Information is absolutely exempt information if it is reasonably available to the applicant, otherwise than under this Law, whether or not free of charge.

(2) A scheduled public authority that refuses an application for information on this ground must make reasonable efforts to inform the applicant where the applicant may obtain the information.​
