Please confirm the number of outstanding (submitted but not investigated) DATIXs within the Jersey Ambulance service from this date, 15 March 2024 and also the number of outstanding DATIXs there were on 22 February 2024, if different from the number now.

The number of outstanding (submitted but not investigated) DATIXs within the Jersey Ambulance service from 15 March 2024 was three.

When stating the number of outstanding DATIX​ (submitted but not investigated) there were on 22 February 2024, there were five that did not have a date or timestamp, so these could have been within the holding area awaiting review or under investigation, meaning it was not possible to identify which at the time this information was requested. There were 18 Datix under review or investigation that had not yet been finalised. 

The DATIX relate to all service areas and not all were submitted by staff, they relate to a range of issues, examples include appointment cancellations, blocked vehicular access, document storage etc.  

It is important to note that some investigations take longer than others to complete based on complexity and any reports that need to be received, along with any mitigations being actioned prior to completion of the investigation.

Where disclosure numbers are fewer than five, disclosure control is applied to avoid identification of individuals. As the number of outstanding DATIXs from 15 March 2024 was three, providing specific dates may identify individuals that have submitted those reports. Article 25 of the Freedom of Information (Jersey) Law 2011 has been applied. A range of submission dates is therefore provided. These range from one prior to November 2023 regarding an admission issue, seven from Nov to Dec 2023 and the remainder from Jan to Feb 2024.

Article 25 - Personal information  

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2018. 

(2) Information is absolutely exempt information if – 

(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2018; and 

(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law. 

3)      In determining for the purposes of this Article whether the lawfulness principle in Article 8(1)(a) of the Data Protection (Jersey) Law 2018 would be contravened by the disclosure of information, paragraph 5(1) of Schedule 2 to that Law (legitimate interests) is to be read as if sub-paragraph (b) (which disapplies the provision where the controller is a public authority) were omitted. ​
