Please confirm which companies submitted tenders with respect to the Organic Waste Recycling to Agricultural Land (Lots 1, 2 and 3 - Biosolids, Gypsum-Enhanced Compost and Agricultural Compost).

The exact details of the tenderers are deemed commercially sensitive and are exempt under Article 33(b) (Commercial Interests) of the Freedom of Information (Jersey) Law 2011.

Article 33 is a qualified exemption; therefore, a public interest test has been applied and is shown at the end of this response.

The Government of Jersey will always seek value for money when procuring services and have systems in place to monitor performance.

Government departments follow the Government of Jersey's procurement processes as defined in the Public Finances Manual and Procurement Best Practice Procedures.

Individual successful and unsuccessful tenderers are able to submit a request to Commercial Services following a request for quote (RFQ) to receive feedback, including scoring, based on their submission/s. This is a confidential process.

Article 33 - Commercial interests

Information is qualified exempt information if –

(a) it constitutes a trade secret; or

(b) its disclosure would, or would be likely to, prejudice the commercial interests of a person (including the scheduled public authority holding the information).

Prejudice / Public Interest Test

Article 33(b) allows an authority to refuse a request for information where its disclosure would, or would be likely to, prejudice the commercial interests of a person (including the scheduled public authority holding the information). Whilst it is accepted that the public may have an interest in the details of Government of Jersey contracts, it is considered that the further details are commercially sensitive and the release of this data could affect the negotiation of future contracts.​
