Request

In accordance with the Freedom of Information (Jersey) Law 2011 on public authorities, I would be grateful if you could supply me with the following information:

In the last ten years have been granted [sic] Release on Temporary Licence (ROTL) to eight prisoners convicted of offences that were categorised as sex offences. I would like to know how many from these eight prisoners have breached their conditions and have lost the temporary licence.

I would like also know how many of these eight prisoners have been reconvicted in relation to sex offences after their release.

Response

We are unable to provide a response to this request.

In accordance with the Freedom of Information (Jersey) Law 2011:

Article 25 - personal information

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2005.

(2) Information is absolutely exempt information if –
(a)  it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2005; and
(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.

Under 25(2)(a) and (b) above, due to the small number of individuals involved, it would be possible for the requester to identify personal information pertaining to a specific individual – the data subject. This would be in contravention of the Data Protection (Jersey) Law 2005.
