Strive is a private venture and the Government of Jersey does not hold the requested information, therefore Article 3 of the Freedom of Information (Jersey) Law 2011 applies.

The Government of Jersey has not provided any subsidies to Strive.

The number of students who have used Strive and the number of PE lessons held at Strive each year since it was opened is not recorded, therefore Article 3 of the Freedom of Information (Jersey) Law 2011 applies.

For the purposes of this Law, information is held by a public authority if –
(a) it is held by the authority, otherwise than on behalf of another person; or
(b) it is held by another person on behalf of the authority.

I would like to appeal this: Strive may be a private venture, but I am asking whether the States paid any money towards it, at all, during either the construction or since. Yes or no and if yes how much. Thanks!

This review has been completed by two senior staff members of the Government of Jersey, independent of the original decision-making process (the Panel).
The original response has been reviewed and assessed to identify whether the application of Article 3 (Meaning of “information held by a public authority) of the Freedom of Information (Jersey) Law 2011 had been applied correctly.
The Panel, having considered all aspects of this case as detailed below.
Strive is a private venture and the Government of Jersey has not contributed any funds regarding the construction of Strive or any ongoing activities.
The Panel’s decision is that the application of Article 3 should not have been applied since the Government were able to confirm that they had not provided any funding to Strive.
