What environmental quality standards are used to determine discharge permit applications?

Information on Jersey specific EQS (Environmental Quality Standards) used to determine discharge permit applications is not held by the Scheduled Public Authority (SPA), therefore Article 3 of the Freedom of Information (Jersey) Law 2011 applies. 

In determining an application for a discharge permit, multiple sources of information and publicly available information on EQS in the water environment (from other jurisdictions) could be used where relevant, in order to achieve the objectives in the Water Pollution (Jersey) Law 2000​ on www.jerseylaw.je.  

The Law sets out general objectives (Article 5), operating considerations (Article 6) and conditions that may be imposed in discharge permits (Article 22).

Article 3 - Meaning of “information held by a public authority”

For the purposes of this Law, information is held by a public authority if –

(a)     it is held by the authority, otherwise than on behalf of another person; or

(b)     it is held by another person on behalf of the authority.​
