Under the Freedom of Information (Jersey) Law 2011, please provide copies of any legal settlement agreements, NDAs, or similar documents entered into by the Government of Jersey (or any subsidiary department or agency) from 2000 to present relating to:

• PFAS or AFFF contamination,

• Pollution associated with the Airport Fire Training Ground,

• Legal correspondence or settlement agreements with 3M or its affiliates, in respect of PFAS liability.

If any part of this request is exempt (for example, under legal professional privilege or commercial confidentiality), please:

1. Confirm whether such documents exist,

2. Specify the exemption(s) applied,

3. State whether any redacted or summary version can be provided in the public interest.

Legal settlement agreements, NDAs, or similar documents entered into by the Government of Jersey from 2000 to present, relating to PFAS or AFFF contamination, pollution associated with the Airport Fire Training Ground or Legal correspondence or settlement agreements with 3M or its affiliates, in respect of PFAS liability are not held by the Scheduled Public Authority (SPA), therefore Article 3 of the Freedom of Information (Jersey) Law 2011 applies.

Article 3 Meaning of “information held by a public authority”

For the purposes of this Law, information is held by a public authority if –

(a)     it is held by the authority, otherwise than on behalf of another person; or

(b)     it is held by another person on behalf of the authority.​
