Dear FOI Officer,
Under the Freedom of Information (Jersey) Law 2011, I request the following:
1. Why has the Government of Jersey stopped maintaining records on heavy metals (e.g. cadmium, mercury, lead) and other hazardous substances in:
• Incinerator bottom ash (IBA)
• Air emissions
• Air Pollution Control Residue (APCR)
2. When was this decision made, and under whose authority?
3. If testing is still undertaken, where can this data be accessed by the public?

Please also provide any internal documents, legal assessments, or correspondence referring to Jersey’s obligations under:
• The Waste Management Licence WML019
• The Waste Management (Jersey) Law 2005
• The EU Waste Incineration Directive 2000/76/EC or Industrial Emissions Directive 2010/75/EU
• The Basel Convention on the Control of Transboundary Movements of Hazardous Wastes, as extended to Jersey via UK ratification (2007)
Please limit the request to material from 2018–2025 held by Environmental Protection, Infrastructure, or public health departments.

Data relating to metals in air emissions and two types of incinerator ash quality is not publicly available.
Other records on compliance with air emission limits (hydrogen chloride, sulphur dioxide, nitrous oxide, carbon monoxide, particulates, volatile organic compounds) are publicly available via www.Gov.je using the link below:

It has been estimated that to provide internal documents, legal assessments, or correspondence referring to Jersey’s obligations under:
• The Waste Management Licence WML019
• The Waste Management (Jersey) Law 2005
• The EU Waste Incineration Directive 2000/76/EC or Industrial Emissions Directive 2010/75/EU
• The Basel Convention on the Control of Transboundary Movements of Hazardous Wastes, as extended to Jersey via UK ratification (2007)
would exceed the 12.5 hours allowed for Freedom of Information responses in accordance with Regulation 2 (1) of the Freedom of Information (Costs) (Jersey) Regulations 2014. Article 16 of the Freedom of Information (Jersey) Law 2011 has therefore been applied.
