Could you advise as to who writes the Questions when deciding on people's health with regards to LTIA please?
Response
The specific form and questions currently used were developed some time ago, and we no longer hold a record of the individual or individuals who originally drafted them. However, the questions were developed by or in consultation with appointed medical board doctors both at the time the benefit was first introduced on 1 October 2004 and during subsequent reviews following amendments to legislation or guidance.
The form used by medical board doctors is designed to help ensure a consistent and fair approach when considering claims for LTIA. It was prepared to reflect the structure and requirements of the legislation. The questions on the form are therefore derived from the legislation and guidance which supports the associated training that medical board doctors receive to carry out their role.
It is important to note that the role of the form is to assist medical board doctors in considering the key legal factors related to eligibility to receive LTIA consistently. However, the legislation specifies that the decision on a claimant’s eligibility for LTIA is made by the medical board doctor, who applies the legislation and guidance directly – not by the form or its specific wording.
