1. The States Police have recent announced a Partnership with Kulpa. As part of the launch the States Police advised that Kulpa is a Jersey company. However, while registering to use the app, the Kulpa privacy policy states that I was providing my data to Kulpa Limited which is a UK registered company. Please could clarity be provided on if Kulpa are a UK or Jersey company.
2. It’s also unclear if Kulpa are acting as a data processor on behalf of the States Police. Please could clarity be provided here as well?
3. If Kulpa are not acting as a data processor, please could the rationale be shared on why the States Police feel it is acceptable to forcefully ask the public to provide their sensitive information to a UK company and why this can’t be provided directly to the States Police.
4. If Kulpa are as it seems a UK company, please could Digital Jersey share their rationale for funding this UK organisation andwhy a local app development company wasn’t used?
Response
1. Kulpa Platforms Ltd is incorporated in Jersey and is a majority shareholder of Kulpa Ltd which is incorporated in England and Wales.
2. Kulpa is a data controller and is registered with both the UK Information Commissioner and the Jersey Office of the Information Commissioner. It is not acting in the capacity of a data processor.
3. The States of Jersey Police has been clear that no one is forced to use Kulpa. Instead, it provides a new additional option in which to report crime. Further information is available at States of Jersey Police innovates with the support of Digital Jersey by connecting to Kulpa (jersey.police.je).
4. Digital Jersey is not a Scheduled Public Authority as defined by the Freedom of Information (Jersey) Law 2011.
