Chief Planning Officer The Planning and Building Law (2002) Jersey in Article 1(1) includes:
““Chief Officer” –
(a) means the person appointed from time to time as the chief executive officer (or equivalent) of the administration of the States responsible for planning and building; and
(b) when referred to in relation to the exercise of any function under this Law, includes any officer of that administration designated by the Chief Officer as carrying out that function;”
A previous FoI request (#Request 687916000) resulted in a response which stated:
“From 2019 to present the Group Director for Regulation acts as the Chief Planning Officer under the Planning and Building Law. This is a delegated power through a formalised Chief Officer decision (attached). “
The FoI response states that it was authored on 15th March 2025.
The response included links to 2 Ministerial Decisions dated in 2019 and 2020 concerning the result. The latter dated of these stated that the Ministerial Decision was:
“In pursuance of Article 1(1) of the Planning and Building Law 2002 (as amended), the Chief Officer (Acting Director General) responsible for the administration of the Planning and Building (Jersey) Law 2002 designates the Director (Development Control) as the responsible officer for such decisions. “

The Director (Development Control) role does not exist; therefore, Article 3 of the Freedom of Information (Jersey) Law 2011 applies.

Article 3 - Meaning of “information held by a public authority”
For the purposes of this Law, information is held by a public authority if –
(a) it is held by the authority, otherwise than on behalf of another person; or
(b) it is held by another person on behalf of the authority.
Article 25 - Personal information
(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2018.
(2) Information is absolutely exempt information if –
(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2018; and
(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.
3) In determining for the purposes of this Article whether the lawfulness principle in Article 8(1)(a) of the Data Protection (Jersey) Law 2018 would be contravened by the disclosure of information, paragraph 5(1) of Schedule 2 to that Law (legitimate interests) is to be read as if sub-paragraph (b) (which disapplies the provision where the controller is a public authority) were omitted.
