Further to my FOI request from November 2024 (653257247) regarding PSHE material by school, I would like to request: 
​​A copy of all materials being used in this school year (2025-26) in each primary and secondary school related to "gender", "gender identity" etc, with details of: 
  1. which school is using each resource, and 
  2. which service provider has provided each resource 
  3. where the resource has been developed internally rather than provided by an external source, please note this.

Please see the attached copies of materials related to PSHE and in particular "gender" and “gender identity” that have been used in Government of Jersey primary and secondary schools.

​Please note, all Government of Jersey schools were asked to provide headline gender and gender identity information, to reference all PSHE materials in schools would take in excess of 12.5 hours, therefore Article 16 of the Freedom of Information (Jersey) Law 2011 has been applied. ​

Articles applied 

Article 16 - A scheduled public authority may refuse to supply information if cost excessive 

(1) A scheduled public authority that has been requested to supply information may refuse to supply the information if it estimates that the cost of doing so would exceed an amount determined in the manner prescribed by Regulations.  

Article 33 - Commercial interests 

Information is qualified exempt information if – 

(a) it constitutes a trade secret; or 
(b) its disclosure would, or would be likely to, prejudice the commercial interests of a person (including the scheduled public authority holding the information).  ​
Public Interest Test  
Article 33 is a qualified exemption and as such, CYPES has conducted a prejudice test as required by law.  
When responding to requests of this nature, CYPES are required to balance the public interest with the impact that disclosing this information would, or would be likely to, have upon the organisation and / or third parties. Whilst it may be in the public interest to understand the content of the resources used by various schools in relation to PSHE provision, protecting the commercial interests of CYPES is essential. 
The use of third parties, to provide resources for schools to support their PSHE curriculum delivery are through contract and/ or purchase. Disclosing information that has been provided with a copyright licence will mean that CYPES are in breach of their contract with that third-party provider and this would prejudice the commercial interests of CYPES.  
When considering the application of this exemption, CYPES has determined that whilst it is in the public interest to disclose the requested resources, this is outweighed by the necessity to limit any impact on its commercial interests in ensuring contractual obligations are met, Article 33 has been applied. ​
