The Sufficiency analysis (strategy) for children in care and care leavers is a dynamic draft document to support internal modelling which aids planning to ensure that there are the right resources for children who need foster homes or residential care and therefore Article 35 of the Freedom of Information (Jersey) Law 2011 is applied.

Article 35 - Formulation and development of policies 

Information is qualified exempt information if it relates to the formulation or development of any proposed policy by a public authority. 

Public Interest Test  

Article 35 is a qualified exemption and as such, CYPES has conducted a prejudice test as required by law.

The Scheduled Public Authority (SPA) considers that while there is a strong public interest in accountability and, as such, the production of documentation aiding  decision making, this interest must be balanced against the equally strong public interest in protecting the process that ensures the final policy decisions are robust, well-considered, and based on complete analysis. The potential for misleading the public and inhibiting the necessary deliberation during the strategic planning stage and given that this document is still a draft and not ratified, outweighs the public interest in releasing this specific, dynamic draft.
