1. How many individuals have had their gender marker, name, and pronouns changed to female within the Government of Jersey’s medical records without a prior referral to a gender identity clinic? 
2. Of those individuals, how many were assigned male at birth and had the marker updated without undergoing psychiatric assessment via a gender clinic? 
3. When did the first such case occur (year)? 

Response 

It is not possible to identify the information requested from records held. Changes made to physical records are not catalogued in a central repository, nor is it possible to report upon changes to gender markers in the previous Electronic Patient Record (EPR) systems. Therefore, Article 3 of the Freedom of Information (Jersey) Law 2011 applies. 
Any changes recorded in the EPR system where the gender field marker has been changed (male → female, female → male) can be identified in audit logs from 27 May 2023 onwards, when the current Maxims EPR system was implemented.  
This dataset represents all recorded changes to the gender field marker in the Maxims EPR, excluding amendments made by those in system configuration roles. However, audit logs do not identify the reason for such changes, therefore, it is not possible to distinguish between: ​
  • Genuine gender identity updates, 
  • Correction of data entry errors, 
  • Updates identified during data quality reviews, 
  • Other administrative corrections. 
As such, the dataset likely includes a significant number of data quality corrections, which cannot be differentiated from genuine gender marker updates in the available audit data. 
The report does not differentiate between individuals who have been referred to or undergone psychiatric assessment via a gender clinic and those that have not. A Scheduled Public Authority is not required to create new datasets to fulfil Freedom of Information requests. 
No historic change data is available to report before 27 May 2023.  
The total number of unique patients with gender marker changes recorded in Maxims is 133, and the total number of change events recorded is 169. 
Some patients had multiple gender marker changes recorded. The patient count reflects unique individuals; the change event count includes all recorded changes.  
​Breakdown of change event count by direction of change (where multiple gender marker changes are recorded against a single patient, each change is reflected in the totals below): 
  • Female → Male: 74 
  • Male → Female: 95 
Owing to the limitations in reporting capabilities noted, these figures should not be interpreted as representing genuine gender identity changes within the patient population.

For the purposes of this Law, information is held by a public authority if – 
(a)     it is held by the authority, otherwise than on behalf of another person; or 
(b)     it is held by another person on behalf of the authority. ​​​​
