Mobile Gear Authorisation scheme

I am requesting the following information held by the Minister for the Environment or Marine Resources relating to the introduction of the Mobile Gear Authorisation scheme in 2024:

• Any published criteria, assessment frameworks, scoring systems, guidance or similar documents that were made available to applicants before or during the June 2024 application period.
• Any public notice, announcement, webpage, bulletin, press release, circular or other communication issued before or during the June 2024 application window which informed the public of the introduction of the scheme or of the criteria that would be applied.
• Any document listing the individuals or organisations classified as “interested parties" who were notified about the scheme in June 2024, together with an explanation of how those parties were identified.

Personal information within the documents has been redacted in accordance with Article 25 (Personal Information) of the Freedom of Information (Jersey) Law 2011. 

The Scheduled Public Authority (SPA), does not hold the requested information such as public notice​s, announcements, webpages, bulletins, press releases, circular or other communications issued before or during the June 2024 application window, therefore, Article 3 of the Freedom of Information (Jersey) Law 2011 applies. 

Jersey Fishing Boat Licence holders were notified about the scheme in June 2024, however individuals names in the document attached have been withheld under Article 25 (Personal Information) of the Freedom of Information (Jersey) Law 2011.

Article 3 - Meaning of “information held by a public authority" 

For the purposes of this Law, information is held by a public authority if – 

(a)     it is held by the authority, otherwise than on behalf of another person; or

(b)     it is held by another person on behalf of the authority. 

Article 25 - Personal information 

(1)     Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2018.

(2)     Information is absolutely exempt information if –

(a)     it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2018; and

(b)     its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.​​
