A request to ascertain how many adults have a learning disability in Jersey. To include age brackets and levels of need (usually between 1-4)

To understand current and future demand on public and charitable services.

Clarification request

Please could the applicant confirm that the 'levels of need' scale relates to those used in respect of Long Term Care, or clarify otherwise?

“Yes, the long term care level would be appropriate for this information – is there somewhere we can access clarity on what each “level" is? I'm assuming this would be for adults – how would the information requested for children with a learning disability be recorded?"

Information relating to care levels can be accessed via the following publicly available sources: 

As the information described above is reasonably accessible to the applicant by other means, Article 23 (Information accessible by other means) of the Freedom of Information (Jersey) Law 2011 applies. 

ESSH holds data on individuals receiving Long-Term Care and their assessed level of need; however, this data does not record whether an individual has a learning disability. Therefore, Article 3 of the Freedom of Information (Jersey) Law 2011 applies.

Article 3 - Meaning of “information held by a public authority"

For the purposes of this Law, information is held by a public authority if –

(a)     it is held by the authority, otherwise than on behalf of another person; or

(b)     it is held by another person on behalf of the authority. 

Article 23 – Information accessible to applicant by other means

(1) Information which is reasonably accessible to the applicant otherwise than under this Law is absolutely exempt information.

(2) For the purposes of paragraph (1), information may be reasonably accessible to the applicant even if it is only accessible on payment, or by way of subscription, or in some other restricted manner.​
