The Control of Housing and Work (Residential and Employment Status) (Jersey) Regulations 2013 came into force on 1 July 2013:

(1) For each year since 2012 up to 2025, please state the number of 2(1)(e) applications granted? (for 2012 please also include any applications granted under the previous 1(1)(k) regulation).

(2) For each year, please state the total number of people entitled to reside in Jersey per application granted. By way of illustration, if, say, there were 10 applications granted in the year 2016, for each of those 10 applications, how many people were on each application. Unless the applicant was a single person with no spouse, partner or dependants, the application would have resulted in the applicant together with his/her spouse/partner and any children they may have taking up residency under that application. So I would like to know the total number of people for each year who took up residency under 2(1)(e) status. 

Response

1.In accordance with the Department's Service Hub, Housing Control published retention schedule found here data is retained for the last 5 years. Therefore, the department does not hold any data prior to 2020. 

As a result, the Department can only provide data for the period 2020 to 2025. As this information is already publicly available online here: High Value Residency, it is reasonably accessible by other means and Article 23 of the Freedom of Information (Jersey) Law 2011 therefore applies. 

(2) The Department can only provide data for the period 2020 to 2025. As this information is already publicly available online here: High Value Residency (Arrivals column) it is reasonably accessible by other means and Article 23 of the Freedom of Information (Jersey) Law 2011 therefore applies. This relates to the total number of people for each year who took up residency with Entitled 2(1) (e) status. 

The Department does not hold data in a searchable format that would allow it to identify how many household members also took up residence with the approved Entitled 2(1) (e) resident for the period 2020 to 2025 therefore Article 3 of the Freedom of Information (Jersey) Law 2011 applies.

Article 3 - Meaning of “information held by a public authority"

For the purposes of this Law, information is held by a public authority if –

(a)     it is held by the authority, otherwise than on behalf of another person; or

(b)     it is held by another person on behalf of the authority.

Article 23 – Information accessible to applicant by other means

(1) Information which is reasonably accessible to the applicant otherwise than under this Law is absolutely exempt information.

(2) For the purposes of paragraph (1), information may be reasonably accessible to the applicant even if it is only accessible on payment, or by way of subscription, or in some other restricted manner.​
