Provide any recorded information held by the Department for Infrastructure and Environment (or its officers or the Minister) that identifies the cause of the water leak in the Rouge Bouillon vicinity, St Helier, which occurred on 23 December 2024 and resulted in the road closure for a considerable period.
The leak was reported as being caused by Jersey Water, but repairs were carried out by the Department for Infrastructure and Environment. I am specifically seeking:

  • Copies of correspondence (including emails, letters, Microsoft Teams messages or internal memos) between the Department for Infrastructure and Environment and Jersey Water, or within the Department, that identify or discuss the cause of the leak.
  • Any reports, assessments, or notes prepared by the Department or its officers regarding the cause of the leak.

Response

The repairs within the boundary of the public highways were carried out by Jersey Water and not by the Infrastructure and Environment Department, the recorded information requested and held by the Public Schedule Authority is attached, and Personal information within the documents has been redacted in accordance with Article 25 of the Freedom of Information (Jersey) Law 2011.

It should be noted that Jersey Water is not a Scheduled Public Authority (SPA) under the Freedom of Information (Jersey) Law 2011, therefore, they are not required to respond.

Articles applied 

Article 23 - Information accessible to applicant by other means 

(1)     Information is absolutely exempt information if it is reasonably available to the applicant, otherwise than under this Law, whether or not free of charge.

(2)     A scheduled public authority that refuses an application for information on this ground must make reasonable efforts to inform the applicant where the applicant may obtain the information. 

Article 25 - Personal information 

(1)     Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2018.

(2)     Information is absolutely exempt information if –

(a)     it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2018; and

(b)     its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.
