Within the past 3 years:
1) How many claims for the employment tribunal service have been filed by past or current HCJ employees?
2) Of this total, how many were settled out of court i.e. before reaching tribunal?
3) What is the total amount of money that HCJ has spent on compromise agreements / settlement agreements with current or former employees?
4) How many former HCJ employees have signed non-disclosure agreements?
Response
1) Within the past three years, 33 employment tribunal claims have been filed by past or current States Employment Board (SEB) employees who worked in Health and Care Jersey.
2) Of the 33 claims, 19 have been settled by mutual consent through compromise/settlement agreements ahead of a final tribunal hearing.
3) Within the past three years, £285,059.51 has been spent from the HCJ budget on compromise/settlement agreements concerning those claims.
4) Confidentiality agreements or non-disclosure agreements (NDAs) may be signed for several different reasons, including:
• prior to, or as part of, a commercial arrangement
• arrangements with external investigators, mediators or third parties
• due to certain staff members undertaking certain sensitive work; and
• in settlement arrangements.
There is no central record held of Non-Disclosure Agreements. Article 3 of the Freedom of Information (Jersey) Law 2011 applies.
