Please could you provide the minutes of all meetings of the Drugs Limit Working Group, which is referred to in the Draft Road Traffic Law (Drug Driving) (Jersey) Amendment Regulations 202-.

Response

We can confirm that the States of Jersey Police (SoJP) do not hold the information you have requested regarding minutes of all meetings of the Drugs Limit Working Group, which is referred to in the Draft Road Traffic Law (Drug Driving) (Jersey) Amendment Regulations 202-. SoJP recorded the actions and decision log during the meetings but not the minutes. As such, we are unable to provide the information you are seeking.

Article 3 of the Freedom of Information (Jersey) Law 2011 applies, and a response is declined.

We have attached the decision logs and action notes from the two meetings held in October 2023 and January 2024 chaired by the States of Jersey Police. The identity of persons present at the meetings aside from the most senior employees who directly report to a Chief Officer or above have been obscured in accordance with government policy and Article 25(2) applies.

Article 3 - Meaning of “information held by a public authority”

For the purposes of this Law, information is held by a public authority if –

(a) it is held by the authority, otherwise than on behalf of another person; or

(b) it is held by another person on behalf of the authority.

Article 25 - Personal Information

(2) Information is absolutely exempt information if –

(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2018; and

(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.
