Provide the following information for the last five financial years (2020-2025), broken down by year: 1. The number of LADO referrals, concerns and allegations relating to nursery settings 2. Of these, how many allegations were recorded as substantiated 3. How many of the referrals/allegations resulted in any action recorded by the LADO (e.g., internal disciplinary action, referral to Ofsted or DBS, or police involvement).

The data is recorded by Early Years sector (Birth to age 5) which would include nursery.
1. The total number of Jersey Designated Officer (JDO) referrals, concerns and allegations relating to nursery settings between 2020 and 2024 was fewer than 5. The Department have determined that to provide the breakdown of these figures by year would likely breach the privacy of individuals therefore Article 25 of the Freedom of Information (Jersey) 2011 Law is applied.
There were 5 JDO referrals, concerns and allegations relating to nursery settings in 2025.
2. The total number of allegations recorded as substantiated was fewer than five for the period requested, the Department have determined that to provide the actual figure would likely breach the privacy of individuals therefore Article 25 of the Freedom of Information (Jersey) 2011 Law is applied.
3. The total number of referrals/allegations that resulted in any action recorded by the JDO (e.g., internal disciplinary action, referral to Ofsted or DBS, or police involvement for the period requested was fewer than five, therefore the Department have determined that to provide the actual figure would likely breach the privacy of individuals, Article 25 of the Freedom of Information (Jersey) 2011 Law is applied.

Article 25 - Personal information
(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2018.
(2) Information is absolutely exempt information if –
(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2018; and
(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.
(3) In determining for the purposes of this Article whether the lawfulness principle in Article 8(1)(a) of the Data Protection (Jersey) Law 2018 would be contravened by the disclosure of information, paragraph 5(1) of Schedule 2 to that Law (legitimate interests) is to be read as if sub-paragraph (b) (which disapplies the provision where the controller is a public authority) were omitted.
