According to the 2021 Jersey Census the total population of the island is 103,267. Of those, 35,822 live in St Helier. That means 34.7% of Jersey's residents live in St Helier, so just over one in three people on the island.

1.Of the 9 Senators, 6 have requested non-disclosure of their personal address. Of theremaining 3, none live in St. Helier.

2.Of the 13 Ministers comprising the Council of Ministers, 8 have requested non-disclosure of their personal address. Of the remaining 5, none live in St. Helier.

(1)Information is absolutely exempt information if it constitutes personal data of which theapplicant is the data subject as defined in the Data Protection (Jersey) Law 2018.

(2)Information is absolutely exempt information if –

(a)it constitutes personal data of which the applicant is not the data subject as definedin the Data Protection (Jersey) Law 2018; and

(b)its supply to a member of the public would contravene any of the data protectionprinciples, as defined in that Law.

This response has been issued on behalf of the States Greffe. The States Greffe is responsible for the information held by (and on behalf of) both itself and the States Assembly. Neither the States Assembly nor the States Greffe form part of the Government of Jersey and the Government was not involved either in the examination and retrieval of any information required for this response, nor in the drafting of the response itself.​

Could I please request an internal review of this FOI response.

The personal addresses of Senators and Ministers was not requested.

I think a response along the lines of 'No Senators or Ministers live in St Helier' would not reveal any personal information.

Furthermore, I think a response to this FOI would be in the public interest.

Internal Review Response

This internal review was conducted by a panel comprising officials of appropriate seniority and experience who were not involved in the original decision. As part of its review, the panel is expected to understand the reasons behind the original response, determine impartially whether the response should be revised and, if so, how, taking into consideration the request and the information held, any relevant exemptions, or other relevant matters under the Law.

The Internal Review Panel was asked to review the original response and confirm the following: Does the FOI request relate to a body to which the Law applies, or information held by a body covered by the Law?

If the answer is no, all the other questions are not applicable. The Internal Review Panel confirmed the request did relate to a body to which the Law applies (the States Greffe). Further questions if the above is a yes:

i. Was the right information searched for and reviewed?

ii. Was the information supplied appropriately?

iii. Was information appropriately withheld in accordance with the articles applied and were the public interest test/ prejudice test properly applied?

The Internal Review Panel confirmed that the right information had been searched and reviewed and that it had been supplied appropriately, with exemption articles under the Law applied correctly. A public interest test was not required as Article 25 (Personal Information) is an absolute exemption.

Following discussion, the Panel agreed to uphold the original decision.
