Draft Waste Management - OECD Revised Decision.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): To approve for lodging the Draft Waste Management (OECD Revised Decision) (Jersey) Regulations 200-.

Reason(s) for Decision: In order to bring into force the Waste Management (Jersey) Law 2005 in a form that will allow DEFRA to seek extension of the Basel Convention to Jersey it is necessary to make these Regulations which give effect to a revised OECD Decision on the Control of Transfrontier Movements of Wastes Destined for Recovery Operations (The OECD Decision). The extension of the Basel Convention is required before Jersey is able to resume the export of hazardous waste for treatment or disposal.

Action required:

The Director of Environment to liaise with the Greffier of the States to lodge these regulations for debate at the earliest opportunity.

DRAFT WASTE MANAGEMENT (OECD REVISED DECISION) (JERSEY) REGULATIONS 200-

A Item

Purpose of the Report

In order to bring into force the Waste Management (Jersey) Law 2005 in a form that will allow DEFRA to seek extension of the Basel Convention to Jersey it is necessary to make these Regulations which give effect to a revised Decision of the OECD. The extension of the Basel Convention is required before Jersey is able to resume the export of hazardous waste for treatment or disposal.

Background

The Draft Waste Management (OECD Revised Decision) (Jersey) Regulations 200- will amend the Waste Management (Jersey) Law 2005 which, though enacted, is not yet in force.

Discussion

The reasons for the amendments are twofold;

1. The Principal Law will implement the OECD Decision on the Control of Transfrontier Movements of Wastes Destined for Recovery which is binding on the island. On March 18th 2004, i.e. after the Law had been lodged, amendments were made to the OECD Decision. These mainly dealt with the classification of wastes.

These Regulations give effect to those minor changes

2. The opportunity has been taken, in introducing these Regulations to give effect to the amendments to the OECD Decision, to also make two minor drafting corrections to the principal Law.

Conclusion

As soon as the principal Law has been brought into force (as is proposed in the draft Appointed Day Act that is also before the Assembly), the United Kingdom Government will take the necessary steps to have the Convention extended accordingly to Jersey.

Recommendation

That these Regulations are brought into force on the 1st of November 2006 in conjunction with the Waste Management (Jersey) Law 2005 (Appointed Day Act) 200-.
