Register of Names and Addresses (Access for Medical Purposes) (Jersey) Regulations 201- & Register of Names and Addresses (Comparison with Electoral Registers) (Jersey) Regulations 201-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision and reason for the decision:

Approval of the :  Register of Names and Addresses (Access for Medical Purposes) (Jersey) Regulations 201-; and Register of Names and Addresses (Comparison with Electoral Registers) (Jersey) Regulations 201-, and Accompanying Reports for lodging, in order to:

  • Register of Names and Addresses (Access for Medical Purposes) (Jersey) Regulations 201-; to improve population-based cancer screening programmes and, in time, to support the overall accuracy of name and address and related basic information held by the Health and Social Services Department
  • Register of Names and Addresses (Comparison with Electoral Registers) (Jersey) Regulations 201-; to undertake feasibility work to support improvements in electoral registration

Resource implications:

  1. Register of Names and Addresses (Access for Medical Purposes) (Jersey) Regulations 201-:  The use of the registrable facts to support population-based cancer screening programmes will be undertaken by in-house resources within normal work schedules without additional costs. As to the broader financial and manpower implications of using the registrable facts to support the electronic patient system known as ‘Trakcare’, the costs of this are not yet determined, but do not arise directly from this Regulation - which enables rather than requires this work to be undertaken – and will be considered as part of overall ICT programmes within agreed budgets.
  2. Register of Names and Addresses (Comparison with Electoral Registers) (Jersey) Regulations 201-:  £5,200 has been allocated from the States Assembly budget for Association of Electoral Administrators to carry out the project with assistance from the Privileges and Procedures Committee, the Comité des Connétables, and relevant States Departments, in particular, the Population Office, the Chief Minister’s Department, and the Social Security Department.

Action required:

(a)    The Chief Minister decided to lodge ‘au Greffe’ the draft Register of Names and Addresses (Access for Medical Purposes) (Jersey) Regulations 201-  and the draft Register of Names and Addresses (Comparison with Electoral Registers) (Jersey) Regulations 201-

(b)    The Greffier of the States to be requested to arrange for the Register of Names and Addresses (Access for Medical Purposes) (Jersey) Regulations 201-  and the draft Register of Names and Addresses (Comparison with Electoral Registers) (Jersey) Regulations 201- to be lodged ‘au Greffe’ as soon as possible for debate as soon as possible.
