Draft Criminal Justice (International Co-operation) (Amendment) (Jersey) Law 200-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister approved the draft Law and accompanying Report prepared by the Law Officers’ Department and instructed officers to lodge it au Greffe.

Reason(s) for Decision:

The draft Law amends the Criminal Justice (International Co-operation) (Jersey) Law, 2001.The States Strategic Plan 2005-2010 includes in its strategic aims the giving of international co-operation. In furtherance of the Strategic Plan, the draft Law aims to strengthen Jersey’s legislative provisions in relation to mutual legal assistance. The draft Law seeks to do this in two ways. The first is by making it an offence for a person to fail to provide evidence in accordance with a notice issued by the Attorney General under Article 5 of the Law. The second way is by broadening Jersey’s ability to provide assistance to other jurisdictions. Currently the provision of assistance to another jurisdiction to enable the enforcement of an overseas forfeiture order is conditional on that jurisdiction being listed, currently in the Criminal Justice (International Co-operation) (Jersey) Regulations 2001, as a designated country or territory to whom assistance can be given. Under the draft Law, the enforcement in Jersey of external forfeiture orders arising from criminal proceedings will no longer be conditional on countries or territories being designated. The amendments are considered necessary in preparation for the International Monetary Fund Assessment in 2008.

Resource Implications:

There are no financial or manpower implications arising from the draft Law.

Officers to lodge the draft Law and accompanying Report au Greffe by 24th September, 2007, in order for the draft Law to be debated on 6th November, 2007.
