Education (Provided Schools - Amendment of Law) (Jersey) Regulations 201-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  To change the name of ‘Jersey College for Girls Preparatory School’ to ‘Jersey College Preparatory School’ with effect from September 2016 and to remove the name of St. James’ School from Schedule 1 (Article 3) of the Education (Jersey) Law 1999 with immediate effect.

Decision(s): The Minister approved for lodging ‘au Greffe’ the Draft Education (Provided Schools – Amendment of Law) (Jersey) regulations 201-, which would change the name of Jersey College for Girls Preparatory School’ to ‘Jersey College Preparatory School’ with effect from September 2016 and remove the name of St. James’ School with immediate effect.

Reason(s) for Decision: Jersey College for Girls Preparatory School is a mixed co-educated school from Reception Class to year 2. At Key Stage 2 (years 3-6) the school is female only. There are currently 99 boys educated at the school. For this reason the Minister has agreed to a change of name for the school to ‘Jersey College Preparatory School’ to reflect the mixed intake of pupils in Reception and Key Stage 1 classes.

 

St. James’ School was the special school for primary aged pupils with Social and Emotional Behavioural Difficulties (SEBD). This school was integrated into a mainstream primary school in 2011-12 following a restructuring of this provision with greater emphasis placed on inclusive work in Jersey’s primary schools. Both the resources and staff were relocated with the provision being based in a mainstream primary school.

 

Provided schools are listed under Schedule 1 (Article 3) of the Education (Jersey) Law 1999. The States may by Regulation amend Schedule 1.

Action required: The Greffier of the States to be requested to arrange for the draft regulations to be lodged ‘au Greffe’ for consideration by the States on 26th April 2016
