Income Support (General Provisions) (Amendment No. 10) (Jersey) Order 2013

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister made the Income Support (General Provisions) (Amendment No. 10) (Jersey) Order 2013

Reason(s) for Decision:    The Draft Social Security (Amendment of Law No.5) (Jersey) Regulations 201- were approved by the States Assembly on 19 March 2013. The regulations introduce a new uprating method for old age pension from October 2013, in line with a public commitment given by the Minister for Social Security in November 2012.  They also provide for a single payment and a revised old age pension rate, which have the combined effect of increasing current pension entitlement in line with the increase in the RPI (pensioners) as at June 2012.

 

The Income Support (General Provisions) (Amendment No. 10) (Jersey) Order 2013 creates a full disregard in respect of the single payment (the 2013 old age pension adjustment) and increases the pension disregard amounts applied to the income support calculation in respect of pensioners aged 65 and above, in line with the maximum increase in respect of the weekly pension rate.

Resource Implications: There are no manpower implications in respect of this Order.   The cost of the adjustments to income support is provided for within the income support uprating budget and is included within the departmental cash limit for 2013. The cost of adjusting pension entitlement and providing a single lump sum in 2013 is estimated at £2.04 million.  This cost will be met from the Social Security Fund.

Action required: Strategy and Policy Director to notify the Greffe and the Law Draftsman that the Order has been made and to forward the signed and sealed Order to the States Greffe, requesting the Greffier of the States to arrange for the Order to be notified to the States.

Explanatory Note

This Order increases the amounts of pension of a person aged 65 or over that are to be disregarded when determining, for the purposes of a claim for income support, the amount of a household’s income. The increase is consequential upon the interim pension increase that will take effect for the period 16th May to 30th September 2013.

This Order also provides for the disregard of the whole of the 2013 old age pension adjustment that is to be paid under Article 25A of the Social Security (Jersey) Law 1974.
