Control of Housing and Work (Jersey) Law 2012, and Register of Names and Addresses (Jersey) Law 2012: Approval of various draft Regulations, Appointed Day Acts, Orders and Report

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Assistant Minister, Chief Minister’s Department approved, for presentation to the States as reports in the ‘R’ series, the following Orders in draft form -

The Assistant Chief Minister approved the following draft Appointed Day Acts and accompanying reports -

  1. Control of Housing and Work (Jersey) Law 2012 (Appointed Day) Act 201- (p.42/2013): Amendment
  2. Register of Names and Addresses (Jersey) Law 2012 (Appointed Day) Act 201- (p.43/2013): amendment

The Assistant Chief Minister approved the following draft Regulations and accompanying reports -

  1. Control of Housing and Work (Business Licences- Annual Charges for Registered Persons) (Jersey) Regulations
  2. Control of Housing and Work (Transitional and Consequential Provisions) (No.2) (Jersey) Regulations 201-

The Assistant Chief Minister approved the following consultation findings report for presentation to the States as a Report in the ‘R’ series -

  1. Consultation Findings Report:  Fees to be presented under the new Control of Housing and Work (Jersey) Law, 201- 

The Minister, The Assistant Minister, Chief Minister’s Department, further requested that items 1 - 2 be laid before the States forthwith, that items 3 and 6 be lodged ‘au Greffe’ as soon as possible for debate at the earliest opportunity and that item 7 be presented to the States forthwith.

Reason(s) for Decision: The Control of Housing and Work (Jersey) Law, 2012 and Register of Names and Addresses (Jersey) Law, 2012, were debated and adopted by the States in July, 2011. The Regulations and Orders support the implementation of the Laws.

Action required: Request the Greffier of the States  -

  • To present the 2 draft Orders to the States as a report;
  • to lodge the 2 draft Appointed Day Acts and 2 draft Regulations ‘au Greffe’,
  • to present the Consultation Findings Report to the States.
