Public Finances (Amendment No. 5) (Jersey) Law 201-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Draft legislation to amend the Public Finances (Jersey) Law 2005 (the Law) to facilitate the direct transfer of funds, and the reporting thereof, from the Strategic Reserve Fund to the Hospital Construction Fund in line with part “d” of P130/2016 – Future Hospital Funding Strategy.      

Decision(s):

The Minister approved the draft amendment and agreed that it should be forwarded for consideration by the Council of Ministers and subject to their approval that:- 

  • it be lodged prior to 7th March 2017 to enable its debate at the same States sitting as P130/2016 – Future Hospital Funding Strategy (18th April 2017); and
  • the draft be forwarded to the Corporate Services Scrutiny Panel so that it could be considered  alongside P130/2016. 

Reason(s) for Decision:  

To ensure that the Law facilitates the direct transfer of funds, and reporting thereof, from the Strategic Reserve Fund to the Hospital Construction Fund, subject to States approval of paragraph “d” of P130/2016.

Resource Implications:

Although there are no direct financial or manpower the draft amendment will enable the direct transfer of funds form the Strategic Reserve Fund to the Hospital Construction Fund within the parameters set in P.130/2016 – subject to States approval of that proposition.

Actions required:

The Head of Decision Support to request:

  • that the draft legislation be forwarded  for Council of Ministers consideration and then to the Corporate Services Scrutiny Panel prior to lodging.
  • Subject to Council of Ministers approval that the Greffier of the States be requested to lodge “au Greffe” the Law - with a request for debate in the States sitting which commences on 18 April 2017 alongside P.130/2016 (subject to States approval of P130/2016.
