The Modern and Military Arms Association Ltd: Open Day - 8 October 2016

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Assistant Minister for Home Affairs authorized a request from The Modern and Military Arms Association Ltd to hold an Open Day on 8th October 2016.

 

Reason(s) for Decision: In accordance with Article 14(3) of the Firearms (Jersey) Law 2000, the Honorary Secretary of The Modern and Military Arms Association Ltd requested the authorization of the Assistant Minister for Home Affairs to hold an Open Day on Saturday 8th October. The Modern and Military Arms Association Limited is an approved shooting club under Article 15 of the Law.

The Modern and Military Arms Association Limited – Application to hold an Open Day on 8th October 2016

 

 

Background

 

An ‘authorized open day’ is defined in Article 14(3) of the Firearms (Jersey) Law 2000 (‘the Law’) as a day on which a shooting club has, with the prior written authority of the Minister for Home Affairs, invited members of the public to engage in target shooting.

 

Article 14(2)(c) of the Law provides that a person who is neither a member nor a bona fide guest of a member of a shooting club may, on an authorized open day and while under the supervision of a member of such a club, have in the person’s possession without holding a firearm certificate a firearm and ammunition while engaged in or in connection with target shooting at a range which is being used by that club.

 

In order to host an authorized open day, a shooting club must have the approval of the Minister for Home Affairs in accordance with Article 15 of the Law.

 

Application

 

The Honorary Secretary of The Modern and Military Arms Association Limited wrote to the Assistant Minister for Home Affairs on 13th September 2016 requesting authorization to hold an Open Day on Saturday 8th October 2016. This was further to a request made to the Club by representatives of a local business.

 

The Modern and Military Arms Association Limited is an approved shooting club under Article 15 of the Law.
