TTS Budget Transfer.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): To approve a budget transfer to the Home Affairs Department amounting to £6,850 in respect of DVS IT transformation costs.

Reason(s) for decision: The Treasury and Resources Department deducted £6,850 in respect of DVS IT transformation costs from the Home Affairs Department’s Cash Limit as opposed to the Transport and Technical Services Department leaving that department with a potential shortfall in its revenue funding.

TRANSPORT AND TECHNICAL SERVICES

BUDGET TRANSFER

Purpose of the Report

The purpose of this report is to seek the Minister for Transport and Technical Services approval to transfer a budget amounting to £6,850 from the Transport and Technical Services to the Home Affairs Department.

Background

Finance Direction No.3.6 ‘Variations to Heads of Expenditure’ sets out the procedures for the transfer of revenue funds and states that requests for transfers of revenue funds from one Department to another require the prior approval of the Minister for Treasury and Resources and the relevant ministers party to the transfer.

Discussion

On 1st January 2006 the Driver and Vehicle Standards Department (DVS) transferred from the Home Affairs Department to the Transport and Technical Services Department. The net income budget that transferred to the department amounted to £78,900 of which £6,850 related to IT transformation costs.

Subsequently, the Treasury and Resources Department deducted £6,850 in respect of DVS IT transformation costs from the Home Affairs Department’s Cash Limit as opposed to the Transport and Technical Services Department leaving that department with a potential shortfall in its revenue funding.

Recommendation

It is recommended that the Minister agrees to transfer a budget amounting to £6,850 in respect of DVS IT transformation costs.

Reason (s) for Decision

The Home Affairs Department has currently funded DVS contribution towards IT transformation costs leaving that department with a potential shortfall in its revenue funding.

Action Required

To notify the Ministers for Home Affairs and Treasury and Resources of this decisions.
