Baudrette Brook Pumping Station: Upgrade: Award of Tender

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Acceptance of tender for Baudrette Brook pumping station upgrade works.

Decision(s): The Minister awarded the contract for the Baudrette Brook pumping station upgrade works to Geomarine Limited in the sum of £712,989.60.

 

Reason(s) for Decision: Geomarine Limited submitted a satisfactory Quality / Price package for the work. The existing Baudrette Brook pumping station is at the end of its asset life. This station pumps surface water out to sea during high tide events when the flows form the surrounding areas can no longer naturally flow out to sea by gravity. This station therefore protects properties from surface water flooding.

 

This project has been out to open tender with only one tenderer submitting a compliant tender. This tender return had three options for varying flow rates and pump suppliers. Upon tender  review the lowest priced option offering a flow rate of 735 l/s per pump was deemed the most economically advantageous option by the evaluation team.

 

The level of work in the water sector is high in the UK due to the stage in the current water Asset Management Plan (AMP) cycle, hence this may have attributed to the lack of submissions from pump suppliers as main contractor, which would usually be expected for this type of contract as it has been in the past. 

 

The original budget for this project was £400,000. This project is £312,919.60 over that budget but can be funded by delaying other projects.

 

Resource Implications: Sufficient Funds are available in Capital Votes Q00MC10012 Replacement Assets and Q00RL10011 Infrastructure. Q00MC10012 will increase by £160,000 and Q00RL10011 will reduce by £160,000. In order to fund this project as it is of high priority some of the pumping station refurbishments and sewer network refurbishments will be postponed to 2019.

 

Action required: Officers to produce a Contract document for the Minister for Infrastructure and the Contractor to sign.
