Road Traffic Orders - amendments

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made (20.04.07) to agree to amendments to the Road Traffic (St. Helier) Order 1996 and the Road Traffic (Disabled Persons) (Parking) Order 2005.

Decision(s):

Reason(s) for decision:

  1. To include currently un-scheduled unloading bays in the Road Traffic (St Helier) (Jersey) Order 1996
  2. To make permanent Temporary Orders, made under Article 68 of the Road Traffic (Jersey) Law 1956, with regard to Conway Street and Kensington Place
  3. To introduce requests from the Parish of St Helier and this Department with regard to Ingouville Lane, Cannon Street, Patriotic Street, Don Street, St Marks Road, Snow Hill car park, and New Street.

TRANSPORT AND TECHNICAL SERVICES

ROAD TRAFFIC ( ST HELIER ) ( JERSEY ) ORDER 1996 AND ROAD TRAFFIC (DISABLED PERSONS) (PARKING) ( JERSEY ) ORDER 2005

Purpose of the Report

To amend the Road Traffic (St Helier) (Jersey) Order 1996, and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2005.

Background

1. Unloading Bays

Over a period of many years, various unloading bays have been installed in the vicinity of the St Helier town centre and not included in the Road Traffic (St Helier) (Jersey) Order 1996. As a result of this lack of legislation, the Parking Control Section of Transport and Technical Services are reporting increasing difficulty in enforcing the intended use of these unloading bays, and it has therefore become necessary to include them in the Road Traffic (St Helier) (Jersey) Order 1996.

2. Streetlife Programme

Two Temporary Orders were made by the Minister of Transport and Technical Services, under Article 68 of the Road Traffic (Jersey) Law 1956, for a period not exceeding twelve months as to facilitate the St Helier Streetlife program. One was made on 18th December 2006 with regard to changes to parking in Kensington Place, and one on 18th April 2006 with regard to changes to parking in Conway Street. These changes are required to be made permanent, and included in the Road Traffic (St Helier) (Jersey) Order 1996, and Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2005.

In addition there are several further requests from the Parish of St Helier, and this Department, for inclusion in the Amendment.

Parish requests

  1. Install parking for motor cycles and mopeds in Ingouville Lane. Plan No. 17.
  2. Extend a small section of prohibition of waiting in Cannon Street. Plan No.18.
  3. Reduce the 1hour scratch card parking on the east side on Patriotic Street by 9 yards.
  4. Move the unloading bay in Don Street and installing additional 20 minute scratch card parking. Plan No.19.
  5. Install one 4 hour disabled persons parking bay in Hue Street. Plan No. 24
  6. Install prohibition of waiting on a section of the eastern side of Pen-y-Craig Avenue. Plan No. 23.
  7. Install an additional resident’s parking space on the north side of St Marks Road.

Transport and Technical Services requests

  1. Install additional prohibition of waiting in St Marks Road. Plan No.20.
  2. Make provision in the Order to compel motorists exiting Snow Hill car park to turn left into Green Street.
  3. Provide two additional 20 minute scratch card parking bays in New Street. Plan No.21.

3. Sunday parking – Residents, parking zone

At the request of the Parish of St Helier, Article 10 of the Order was changed as part of Amendment No.20 (signed by the Minister on 5th January 2007) to enable paycard parking on Sundays in the visitors’ parking spaces in the Residents’ parking zone.

Subsequent to the making of the change and the placing of new signs on street, it came to light that the TTSd’s paycard format did not allow for a card to be validated for “time of arrival” on a Sunday.

Part of the present draft amendment No.21 request could include further change to Article 10 to enable a revision to free Sunday parking, but the decision of a recent meeting between Officers from this Department and from the Parish is that the Article should not be further amended at this time. Until the issue of pay parking on a Sunday can be addressed the honorary police will not issue tickets for parking in these spaces on Sundays.

Discussion

Unloading bays

The existing unloading bays requiring inclusion in the Road Traffic (St Helier) (Jersey) Order 1996 is as follows:-

Due to the forthcoming extension in club licensing hours from the current 1am to 3am, it has been decided with the exception of the unloading bays outside of the Market, Patriotic Street, and the bays on footways in Bath Street and Halkett Place, that all other unloading bays in the town area should be available for public parking until 5am, as opposed to the current 2am deadline. The new hours for loading and unloading shall therefore be 5am to 6pm, Monday to Saturday. Outside of these times the bays will be available for public parking. Motorists using the bays for the loading and unloading must display the business name and address of the user of the vehicle, and time of arrival. The duration of loading and unloading shall not exceed 20 minutes.

Temporary Orders made under Article 68 of the Road Traffic ( Jersey ) Law 1956 (St Helier Streetlife Programme)

The items requiring inclusion in the Road Traffic (St Helier) (Jersey) Order 1996 and Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2005, and currently subject to temporary Orders under Article 68 of the Road Traffic (Jersey) Law 1956 are as follows:-

Conway Street

On-street parking. The one-hour scratch card parking adjacent to the Pomme D’Or Hotel, between the Esplanade and Wharf Street removed and waiting prohibited.

Disabled persons parking. The four disabled persons parking bays between Wharf Street and Cross Street removed and relocated in Broad Street and The Esplanade as follows:-

Broad Street - Directly westwards from the existing disabled space adjacent to “The Blue Note” bar, for a distance of 12 yards, two 20 minute on-street parking spaces will be converted to two disabled spaces with a 4 hour limit.

The Esplanade - Two one hour parking spaces approximately 16 yards from its junction with Conway Street will be converted to two disabled spaces with a 4 hour limit. The spaces will extend eastwards for a distance of 12 yards from the motorcycle parking bays.

Unloading bays. The existing bay in Conway Street adjacent to the public toilet between Cross Street and Bond Street will be retained, but will be restricted as follows:-

The times of loading and unloading shall be 5am to 6pm, Monday to Saturday. Outside of these times the bays will be available for public parking. Motorists using the bays must display the business name and address of the user of the vehicle, and time of arrival. The duration of loading and unloading shall not exceed 20 minutes.

Kensington Place

To facilitate the construction of two chicanes in Kensington Place it has been necessary to relocate a section of one-hour scratch card parking and unloading bays as follows:-

On-street parking. Relocate the existing one-hour scratch card parking located between the exit to Patriotic Street car park and the junction with Kensington Street to the west side, from a point 11 yards north of the exit to Patriotic Street Car Park for a distance of 10 yards northward.

Unloading bays. Relocate the bays to the west side, from a point 21 yards north of the exit from Patriotic Street car park for a distance of 13 yards northward.

Times of loading and unloading shall be between the hours of 8am to 6pm, Monday to Saturday. Outside of these hours the bays will be available for public parking. Motorists using the bays must display the business name and address of the user of the vehicle, and time of arrival. The duration of loading and unloading shall not exceed 20 minutes.

Additional items requested by the Parish of St Helier , and this Department for inclusion in the Amendment.

Parish requests

The request to install motorcycle and moped parking in Ingouville Lane is considered necessary due to the increasing demand for such facilities in the Town area.

The request to increase the prohibition of waiting in Cannon Street is considered necessary to allow the refuse collectors vehicle to access the bin area for the nearby flats, free from obstruction by parked vehicles.

The request with regard to reducing the recently introduced 1 hour scratch card parking in Patriotic Street by 9 yards is due to complaints of vehicles obstructing access to nearby properties.

The request to move the unloading bay in Don Street and install additional 20 minute scratch card parking is so that the unloading bay is closer to commercial premises in the area, and the need for additional on-street parking.

The request to install a disabled persons parking bay in Hue Street is considered desirable due to the lack of such a facility in the vicinity of the new Magistrates Court.

The request to install a section of prohibition of waiting on the east side of Pen-y-Craig Avenue is due to the lack of adequate visibility when exiting King’s Court Apartments.

Transport and Technical Services requests

The request to install an additional section of prohibition of waiting on the south side of St Marks Road, between David Place and Jarvrin Road, is considered necessary due to the danger of vehicles parking opposite legalised parking on the north side of the road, and potentially causing an obstruction to oncoming vehicles.

Although there are signs in place to direct motorists to turn left when exiting the Snow Hill car park into Green Street, there is currently no legislation to compel them to do so. As turning right onto the roundabout from the car park is considered a dangerous manoeuvre, it has now become desirable to include this restriction in the Order.

The request to introduce two additional 20 minute scratch card parking spaces in New Street is due to lack of parking facilities in the area, in a location not likely to cause an obstruction to oncoming traffic.

Recommendation

The Minister is recommended to approve the requests.

To include additional requests from the Parish of St Helier, and this Department, in the above Order.

To make permanent parking changes in the town area currently subject to a temporary Order made under Article 68 of the Road Traffic (Jersey) Law 1956.
