Motor Vehicle Registration (General Provisions) (Amendment No. 18) (Jersey) Order 2010

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Motor Vehicle Registration (General Provisions) (Amendment No 18) (Jersey) Order 2010.

Decision(s):  The Minister made the Motor Vehicle Registration (General Provisions) (Amendment No18) (Jersey) Order 2010 and requested the Deputy Inspector to take the necessary action to implement the Order.

Reason(s) for Decision: To amend the principal Motor Vehicle Registration Order to permit the DVS Unit to collect Vehicle Emissions Duty on behalf of the Agent of Impôts from 01 September 2010.

Resource Implications: Cost of Gazette advertisement by TTS – DVS Unit. Customs Department will pay for updated DVS publicity and amended Application to Register a Motor Vehicle Forms.

Action required: To notify the Greffier of the States and the Law Draftsman that the Order has been made and forward the signed and sealed Order to the Publications Editor at the States Greffe for notification to the States.  

Order to be published in the Gazette.

MOTOR VEHICLE REGISTRATION (GENERAL PROVISIONS)  

(AMENDMENT No 18) (JERSEY) ORDER 2010  
 
 

Purpose of the Report  

To request the Minister for Transport and Technical Services to make the Motor Vehicle Registration (General Provisions) (Amendment No 18) (Jersey) Order 2010. 
 

Background  

The States agreed to introduce a Vehicle Emissions Duty from 01 September 2010 and the amendments in this Order gives powers to the Driver and Vehicle Standards Unit to collect this duty on behalf of the Agent of Impots. 

The Minister for Transport and Technical Services, on the basis of Ministerial Decision MD-T-2010-0052, has agreed in principle to the required amendments to the principal Order which:- 

(I)     Requires the CO2 emission rate for Light Passenger Vehicles be included in the particulars of motor vehicles contained in the register of motor vehicles.

 

(II)     Requires all outstanding customs duty or tax due in respect a vehicle applying to be registered be paid before such registration can take place.

 

(III)     Amend and de-prescribe the Application to Register a Motor Vehicle Form.

 

(IV)     Require an applicant to register a motor vehicle to produce a Jersey driving licence (in respect of an individual application) and satisfactory evidence of vehicle ownership.

 
 

Discussion 

The Law Draftsman was asked to prepare the necessary changes to the Order on the basis of a brief provided by the Deputy Inspector of Motor Traffic. 

The Law Draftsman has advised whilst it was possible to amend the Application to Register a Motor Vehicle Application Form it was not possible to de-prescribe it solely by means of amending the principal Order. Consequently the form has been amended but will remain in the Order.

The Law Draftsman has also included in Amendment No 18 a definition of a Light Passenger Vehicle. This enables such vehicles – which are the only ones which will - pay Vehicle Emissions Duty calculated on CO2 Emissions.  
 

Recommendation 

The Minister is recommended to make the Motor Vehicle Registration (General Provisions) (Amendment No 18) (Jersey) Order 2010 and request the Deputy Inspector to take the necessary action to implement the Order.
