Marriage and Civil Status (Approved Premises) (Amendment) (Jersey) Order 2012

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister made the Marriage and Civil Status (Approved Premises) (Amendment) (Jersey) Order 2012.

Reason(s) for Decision: The Civil Partnership (Jersey) Law 2012 is due to come into force on 2 April 2012 and will enable same sex couples to enter into civil partnerships.  This Order amends the Marriage and Civil Status (Approved Premises) (Jersey) Order 2002 and specifies the fees that are payable where premises are already approved for the purposes of solemnizing civil partnerships and wish to solemnize marriages; or where premises are not yet approved for solemnizing marriages or civil partnerships and wish to be approved for the solemnization of both. See MD-HA-2012-0019 for the previous related decision.

Explanatory Note

This Order amends the Marriage and Civil Status (Approved Premises) (Jersey) Order 2002 by specifying the fees that are payable upon an application for approval of premises at which marriages may be solemnized in a case where either approval has been given for the solemnization of civil partnerships at those premises or the application is made for approval at the same time as an application for approval of those premises for the solemnization of civil partnerships.

In a case where premises are already approved for a 1 year or 3 year period for the solemnization of civil partnerships pursuant to a scheme established under the Civil Partnership (Jersey) Law 2012, the fee payable on application for approval of those premises for the solemnization of marriages for the remainder of the period of the approval for the solemnization of civil partnerships is £40.

In any other case the fee payable on application for approval of premises for the solemnization of marriages for 1 year or 3 years remains, respectively, £200 or £300, and where the application is made at the same time as an application for approval of those premises for the solemnization of civil partnerships, the total fee payable in respect of both applications for approval for 1 year or 3 years is £200 or £300 respectively.

THE MINISTER FOR HOME AFFAIRS, in pursuance of Articles 18 and 82 of the Marriage and Civil Status (Jersey) Law 2001, orders as follows 

1 Schedule 2 amended

In Schedule 2 to the Marriage and Civil Status (Approved Premises) (Jersey) Order 2002, for the entries appearing under the heading “FEES” there shall be substituted the following paragraphs 

“1. The fees specified for the purposes of Article 2(3)(b) are as follows 

 

(a)

for an application for approval of premises for a specified marriage

£100

(b)

in a case where approval has been granted in respect of premises for a 1 year or 3 year period for the solemnization of civil partnerships pursuant to a scheme established under Article 13(3) of the Civil Partnership (Jersey) Law 2012, for an application for approval of those premises for a period ending on the date that the said approval for the solemnization of civil partnerships ends

£40

(c)

for an application for approval of premises for a period of 1 year

£200

(d)

for an application for approval of premises for a period of 3 years

£300

2. Where an application is made under this Order for an approval for 1 year of premises at the same time as an application is made for approval for 1 year of those premises for the solemnization of civil partnerships pursuant to a scheme established under Article 13(3) of the Civil Partnership (Jersey) Law 2012, the total fee payable in respect of both applications shall be £200.

3. Where an application is made under this Order for an approval for 3 years of premises at the same time as an application is made for approval for 3 years of those premises for the solemnization of civil partnerships pursuant to a scheme established under Article 13(3) of the Civil Partnership (Jersey) Law 2012, the total fee payable in respect of both applications shall be £300.”.

2 Citation and commencement

This Order may be cited as the Marriage and Civil Status (Approved Premises) (Amendment) (Jersey) Order 201- and comes into force on 2nd April 2012.
