Cold Weather Bonus and Payments (Miscellaneous Amendments) (Jersey) Regulations 202-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Report Title: Lodge Cold Weather Bonus and Cold Weather Payments Miscellaneous Amendments Regulations

Decision(s):

The Minister approved the Draft Cold Weather Bonus and Payments (Miscellaneous Amendments) (Jersey) Regulations 202- and requested that the Regulations be lodged "au Greffe".

Reason for Decision(s):

The Cold Weather Bonus and Payments (Miscellaneous Amendments) (Jersey) Regulations 202-, if passed, would amend the Income Support (Special Payments) (Cold Weather Payments) (Jersey) Regulations 2008, and the Social Security (Bonus) (Jersey) Law 2014 (the “2014 Law”). The amendments relate to the cold weather payments under the 2008 Regulations and the cold weather bonus under the 2014 Law. For a temporary period running from October 2022 to the end of March 2023 (“cold weather months”), the current formula for the calculation of the payments and bonus for these cold weather months is replaced by a fixed amount of £70. On the expiry of these temporary amendments at the end of April 2023, the formula for the calculation of the cold weather payments and bonus from October 2023 onwards is reinstated with an updated figure for RPI.

Resource Implications: Setting a fixed monthly value of £70 requires an additional £0.4M in 2022 and £0.4M in 2023. Funding in 2022 will be drawn from existing allocated Tax Funded departmental budgets. The additional funding of £0.4 million will be incorporated into the proposed Government Plan 2023-26 to support the additional cost for January to March 2023. There are no manpower implications.

 

Action Required: Officers to request the Greffier of the States to arrange for the item(s) to be lodged 'au Greffe'.
