Building Bye-laws (Jersey) 2007: Proposed Amendments

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  

The Minister decided to make amendments to the building bye-law requirements relating to the conservation of fuel and power and drainage provision and to publish new technical guidance documents in support of the requirements relating to conservation of fuel and power and ventilation. The five new technical guidance documents are to take effect from January 2011.

Reason(s) for Decision: 

To improve the energy performance of buildings, and to make provision in the bye-laws to allow the installation of packaged wastewater treatment systems.

Resource Implications: 

No resource implications are envisaged.

Action required: 

The Minister requested the Law Draftsman to prepare amendments to the Building Bye-laws (Jersey) 2007 in accordance with the relevant provisions of the Planning and Building (Jersey) 2002, based on instructions to be provided by the department.

The Minister to publish the following technical guidance documents for the purposes of providing guidance on meeting the functional requirements of Part 5 and 11 of the second schedule to the Bye-laws:

·     Technical Guidance Document Part 5.          (Ventilation) 2011 Edition.

·     Technical Guidance Document Part 11.1A.  (Conservation of Fuel and Power) 2011 Edition.

·     Technical Guidance Document Part 11.1B.  (Conservation of Fuel and Power) 2011 Edition.

·     Technical Guidance Document Part 11.2A.  (Conservation of Fuel and Power) 2011 Edition.

·     Technical Guidance Document Part 11.2B   (Conservation of Fuel and Power) 2011 Edition.

Proposed amendments to the Building Bye-laws (Jersey) 2007 to revise requirements relating to conservation of fuel and power and drainage provision for buildings.

 

 
 

Purpose of the Report

This report brings to the minister the results of the recently published public notice inviting comments on proposed changes to the Building Bye-laws (Jersey) 2007. It proposes that no changes are made to the consultation draft as published and seeks approval to make the necessary changes to the Building Bye-laws (Jersey) 2007 and to publish revised technical guidance documents. 

Background and Discussion

The building bye-law requirements relating to ventilation and the conservation of fuel in buildings were revised in 2009 with new supporting technical guidance published. Following concerns about the effect of those changes, which were solely raised by Jersey Gas, the Planning and Environment Minister decided not to actively enforce the new requirements which came into effect in January 2010. A number of discussions have since taken place with Jersey Gas, Jersey Electricity and the Oil Fuel supply companies, in order to find a solution to the concerns raised by Jersey Gas, whilst at the same time, strengthening the bye-law requirements in a way that improves the energy performance of buildings. The solution agreed upon was that references in the bye-laws to CO2 emission targets would be removed and these would be replaced with energy targets. Draft bye-laws incorporating those changes were published on the 2nd July 2010 with interested parties being given 18 days to comment. In addition, the opportunity has been taken to amend the bye-law requirements relating to drainage provision, to permit the installation of packaged wastewater treatment systems. 

Responses to the public notice inviting comments on the proposed changes.

At the time of writing no comments have been received in relation to the proposed changes. The deadline for responses was 20 July 2010.  

Legal and resource implications

Article 31 (2) of the Planning and Building (Jersey) Law 2002 empowers the minister to make Building Bye-laws, including bye-laws, to prevent the waste, undue consumption or misuse of fuel and energy in or about buildings. The proposed amendments involve minor changes to the current provisions and as such there will be no resource implications arising from the adoption of the new bye-law requirements. 
 
 

Recommendation

It is recommended the minister:

1.     Agrees to instructions being sent to Law Draftsman’s office to amend the Building Bye-laws as detailed in the published draft bye-laws (Amendment No 2).

2.     Approves the publication of the 2011 Editions of the Technical Guidance Documents Parts 5, 11.1A, 11.1B, 11.2A, and 11.2B which will take effect from 01/01/2011.
